Thank you for visiting Dominion General Counsel, PC’s (“Firm”) website — DominionGC.com (“Website”). The use of the Website is subject to this Terms of Use Agreement (“Agreement”). By accessing the Website, you (“User”) agree to comply with the terms contained in this Agreement. If User does not agree to these terms, User should refrain from using the Website.

Overview

This website presents general information about the Firm and other materials and content for informational purposes only. The information, materials and content do not constitute and are not intended as legal advice. To obtain legal advice or legal services from the Firm, User must first establish an attorney-client relationship with the Firm.

1. Attorney-Client Relationship

Our content is offered as a means to introduce the Firm and to assist users when making a decision regarding legal counsel options. User’s use of the Website is not intended to and does not create an attorney-client relationship or professional relationship of any kind between Firm and User. An attorney-client relationship does not exist until Firm and a prospective client have agreed in writing to establish a relationship.

2. General

By using Website, User warrants that User is at least 18 years old (or the minimum legal age in the jurisdiction in which you are viewing the Website). User may not use the Website for any unlawful purpose. Firm may change any provision in this Agreement at any time without notice. Once the changes appear in this Agreement, User’s continued use of the Website will constitute User’s agreement to the modified terms. User may print a copy of the Agreement for reference.

3. Warranty Limitation

User assumes the risk of using the Website and all Website content, including but not limited to all documents, text, data, files, tools, pages, links, software applications, and features of any kind (“Content”). Except where otherwise expressly provided in writing with User, User agrees that Firm provides the Content “as is” with no express or implied warranty of any kind.

4. Modification of Terms of Use

User understands and agrees that Firm may discontinue or change the Website at any time, without notice. Also, User understands and agrees that Firm may discontinue or restrict User’s use of the Website for any reason without notice.

5. Copyright Protection

The Content is the property of Firm or its licensors, and is protected by US and international copyright and other intellectual property laws. Unless expressly authorized in writing, copying or reproduction of Content is strictly prohibited.

6. Links to Other Sites

The Website contains hyperlinks to websites operated by third parties. The hyperlinks are provided for the gratuitous benefit of User. A hyperlink to a third party website does not imply Firm’s endorsement of the content on or the business activity identified in the hyperlinked website.

7. Limitation of Liability

By using Website, User is agreeing that under no situation is Firm responsible for: a) any liability resulting from Content contained in, displayed on, or omitted from the Website; b) any person’s reliance on any such Content, whether or not the Content is correct, current or complete; or c) the consequences of any action User or any other person takes or fails to take, whether or not based on information provided by or as a result of the use of the Website. In no event is Firm liable for any indirect, incidental, special or consequential damages, resulting from the use or the inability to use the Website or for cost of procurement of substitute goods and services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the Website or resulting from unauthorized access to or alteration of User’s transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible, even if the center has been advised of the possibility of such damages. In the event Firm is found liable, the liability to user or any third party is limited to $5. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above limitations may not apply to User.

8. User Indemnification

User agrees to indemnify, hold harmless, and defend Firm from all reasonable expenses it incurs, including reasonable court costs and legal fees, enforcing its rights under this Agreement upon a violation of the Agreement, including but not limited to User’s misuse of the Website or Content, and the violation of any law related to the use of the Website.

9. Unsolicited Electronic Communications

No attorney-client or vendor-customer relationship exists between Firm and either User or any third party until Firm specifically accepts representation in writing. An unsolicited email, voice message, text message, social media message, fax or other similar unsolicited electronic communication submitted by User to Firm (“Unsolicited Communication”) does not form an attorney-client or vendor-customer relationship and is not subject to any attorney-client relationship. User should not provide any confidential information or matter specific information in an Unsolicited Communication (“User Provided Confidential Information”). User Provided Confidential Information contained in an Unsolicited Communication is shared at User’s own risk and without any expectation of confidentiality. For purposes of this warning, the Firm includes Dominion General Counsel, P.C., its staff and its subsidiaries.

10. Website Content

The content provided on the Website, such as the articles, forms, tips, FAQs and other similar content, is provided “as-is” and at User’s own risk. Content such as articles, forms, tips and FAQs is not intended for every fact situation and is provided as a courtesy for general informational and reference purposes only. All the content is provided while considering the laws of Commonwealth of Virginia and no other jurisdiction, the content might not apply to all facts and situations in Virginia. User will need to modify any form to match the User’s specific fasts, needs and jurisdiction. Prior to using any content, especially forms, User must adjust the content to match the applicable facts of User’s situation, User’s needs and the national, regional, state and or local laws.
